Seaport Security Plans -- Who Needs To Comply? Under Homeland Security regulations, CFR 33:105, all US port facilities receiving foreign vessels of 100 tons or more or that handle “certain dangerous cargoes” were required to submit Port Facility Assessments and Port Facility Security Plans to the US Coast Guard by December 31, 2003 and have those plans in operation by July 1, 2004. These regulations not only pertain to public or government run ports, but to those who operate private docks and terminals as well. It costs nothing to inquire, but failure to have a plan in place and to be in compliance could result in fines, having your facility blocked from receiving vessels, and leave it vulnerable to domestic and international terrorism.
